Advice to International Passengers on Limitation of Liability

Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of a treaty known as the Warsaw Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination. For such passengers on a journey to, from, or with an agreed stopping place in the United States of America, the Convention and special contracts of carriage embodied in applicable tariffs provide that the liability EUROPEAN GLOBAL JET and certain other carriers parties to such special contracts, for death of or personal injury to passengers is limited in most cases to proven damages not to exceed US Dollars 75,000 per passenger, and that this liability up to such limit shall not depend on negligence on the part of the carrier. For such passengers traveling by a carrier not a party to such special contracts or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the carrier for death or personal injury to passengers is limited in most cases to approximately US Dollars 10,000 or US Dollars 20,000. The names of carrier parties to such special contracts are available at all ticket offices of such carriers and may be examined on request. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier's liability under the Warsaw Convention or such special contracts of carriage. For further information please consult your airline or insurance company representative. NOTE: The limit of liability of US $ 75,000 above is inclusive of legal fees and costs except that in case of a claim brought in a state where provision is made for separate award of legal fees and costs, the limit shall be the sum of US $ 58,000 exclusive of legal fees and costs.

NOTICE OF BAGGAGE LIABILITY LIMITATIONS - For most international travel (including domestic portions of international journeys) liability for loss, delay, or damage to baggage is limited to approximately US $ 9.07 per pound (US $ 20.00 per kilo) for checked baggage and US $ 400.00 per passenger for unchecked baggage unless a higher value is declared in advance and additional charges are paid. Excess valuation may not be declared on certain types of valuable article. Carries assume no liability for fragile, valuable or perishable articles.

Restricted Articles

For safety reasons, restricted articles such as those listed below, shall not be carried in passengers' baggage without consent of and prior arrangement with Carrier, except that medicinal and toilet articles in small quantities which are necessary or appropriate for the passenger during the journey, such as hair sprays, perfumes and medicines containing alcohol, may be carried without prior approval.

  • Compressed gases (Flammable, non-flammable and poisonous).
  • Corrosives (such as acids, alkalis and wet cell batteries).
  • Explosives munitions, fireworks and flares.
  • Flammable liquids and solids (such as lighter or heating fuels, matches and articles which are easily ignited).
  • Oxidizing materials (such as bleaching powder and peroxides).
  • Poisons.
  • Radioactive materials.
  • Other restricted articles (such as mercury, magnetized material, offensive or irritating materials).

Advice to Passengers on Waiver of Liability

By special contract EUROPEAN GLOBAL JET Ltd. has voluntarily waived limits of liability for death or bodily injury under Article 22 (1) of the Convention and the defense that it has taken all necessary measures to avoid such damage set out in Article 20 of the Convention for the first 100,000 Special Drawings Rights of liability. In addition, EUROPEAN GLOBAL JET Ltd. agreed to make advance payments to persons entitled to compensation in cases of death or bodily injury of passengers. Specific details of the provisions applied by EUROPEAN GLOBAL JET Ltd are available from the airline, on request.

Notice in case of flight delay

Passengers have the right to cancel the carriage contract, after reservation is made, by a cancellation notice given to the carrier subject to the following conditions:

  • If notice is given not less than 72 hours prior to flight departure then passenger shall receive refund or flight fare less 25%.
  • If notice is given less than 72 hours but not less than 24 hours prior to flight departure then passenger shall receive refund of flight fare less 50%.
  • If notice is given less than 24 hours prior to flight departure, or if no notice at all, passengers shall receive refund of flight fare less 51%.

Cancellation, Rerouting, Delays, Etc.

(a) We will take all necessary measures to avoid delay in the Carriage of you and your Baggage. In the exercise of these measures and in order to prevent a flight cancellation, in exceptional circumstances we may arrange for a flight to be operated on our behalf by an alternative Carrier and/or aircraft.

(b) Except as otherwise provided by the Convention, if we cancel a flight, fail to operate a flight reasonably according to the schedule, fail to stop at your destination or Stopover destination, cause you to miss a connecting flight on which you hold a confirmed reservation or make a substitution of the operating Carrier which has not previously been disclosed and which is not acceptable to you, we shall, at your option, either:

  • (i) Your Carriage at the earliest opportunity on another of our scheduled services on which space is available without additional charge and, where necessary, extend the validity of your Ticket until our first flight on which space is available; or
  • (ii) within a reasonable period of time re-route you to the destination shown on your Ticket by our own services or those of another Carrier, or by other mutually agreed means and class of transportation without additional charge. If the fare and charges for the revised routing are lower than what you have paid, we shall refund the difference;

(c) The liability provisions in Article 15.4 also apply to events described in Article 9.2 (b).

(d) Upon the occurrence of any of the events set out in Article 9.2 (b), except as otherwise provided by the Convention, the options outlined in Article 9.2 (b) (i) through Article 9.2 (c) are the sole and exclusive remedies available to you and we shall have no further liability
